Bernstein: SEC and CFTC to Accelerate Rules Despite CLARITY Act Failure

The U.S. Digital Asset Market Structure Act, also known as the CLARITY Act, failed to pass the Senate, raising concerns that regulatory authority will shift to the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC). Bernstein anticipates these agencies will move quickly to establish rules on token classification, decentralized finance (DeFi), self-custody, and tokenized securities, compensating for time lost during legislative negotiations.
