Bitcoin has held above its long-term moving average line despite market volatility following the failed vote on U.S. cryptocurrency regulatory legislation. Analysts suggest this positioning represents a technical bullish signal. The immediate short-term focus remains on whether Bitcoin can maintain support near $74,600 and break through resistance at $80,000.

During an interview with Schwab Network on September 16 (local time), Nathan Peterson, Head of Derivatives Research & Strategy at Schwab Financial Center, stated that the Clarity Act's failure to secure the necessary 60 votes in the Senate was not a positive development for Bitcoin. Peterson noted that Bitcoin rose over 2% on Monday due to anticipation of the vote but subsequently fell about 4% after the failed vote.

Peterson explained that while the Clarity Act could have provided regulatory clarity and boosted institutional investment, its failure to pass has weighed on the market. The vote results showed 49 votes in favor, 50 against, with three Republican members defecting. He highlighted former President Donald Trump's personal cryptocurrency investments as a key factor in the legislative impasse.

Peterson cited the Kalshi prediction market, indicating only a 13% probability of the Clarity Act passing by October next year and a 21% chance by January 2028. He cautioned that while Coinbase CEO Brian Armstrong may seek regulatory clarity through legal challenges against CFTC and SEC, "it's clearly not the same as legislation being enacted."

At the time of reporting, Bitcoin was trading around $75,600. Peterson noted that recent fiscal issues, currency devaluation trades, and long-term interest rate fluctuations have influenced Bitcoin's price rebound. He emphasized that Bitcoin's ability to remain above its 200-day simple moving average represents a technical bullish signal.

The immediate support level is positioned around $74,600 where the 200-day SMA sits, with Peterson stressing this level's importance for maintaining a bullish outlook. Conversely, he identified $80,000 as the next resistance level, noting that significant average accumulation prices are concentrated in this area leading to potential trading congestion.

Seasonal factors and the four-year cycle were also cited as potential favorable elements for Bitcoin. Peterson explained that while September is not typically a strong month seasonally, October has historically shown consistent strength over the past decade. However, he cautioned that past performance does not guarantee future results, noting that market sentiment may shift toward bullishness around late September to early October during the halving cycle period.
