Bitcoin (BTC) has surged 38% despite stalled progress on the U.S. Clarity Act for virtual assets, with analysts emphasizing that regulatory changes are less influential than interest rates and actual capital flows.

The Clarity Act, which failed to advance in a Senate vote due to insufficient support (49 votes against the required 60), faced concerns about delaying institutional investment. However, Matt Hogan of Bitwise, CIO, revised his earlier view that market stagnation would extend by six weeks if the bill stalled, noting Bitcoin rose from around $57,950 on July 1 to over $80,000 as of April 4, even as Clarity Act passage probability dropped from 39% to 18%.

Bitwise’s Hogan highlighted that financial institutions like Robinhood and Morgan Stanley are expanding crypto ventures without waiting for legislative action, citing initiatives such as Robinhood’s blockchain launch and Morgan Stanley’s Solana ETF. Bloomberg analyst James Seapert noted Bitcoin already has a commodity status in the U.S., with spot ETFs approved by the SEC in January 2024, allowing institutional access via existing brokerage accounts.

Market analysts now point to interest rates and ETF inflows as key drivers. Rachel Lucas of BTC Markets stated current markets are more influenced by rate policies than regulatory expectations, while Justin Danetan of Arctic Digital stressed Bitcoin’s price record without the Clarity Act. The Fed recently raised rates by 0.25%, targeting a 3.75%-4.00% range, and U.S. spot BTC ETFs saw $100 million inflows early April but shifted to $33.4 million outflows between April 8-14.
