CLARITY Act Faces Critical Crossroads as U.S. Senators, States, and Banks Unite in Opposition

The U.S. Senate's cryptocurrency regulation bill, the CLARITY Act, is at a critical juncture as it approaches a procedural vote.

Democratic Senate Banking Committee staff, including Senator Elizabeth Warren's team, have raised objections to recent ethical compromise amendments in the bill. The core dispute centers on whether new provisions granting enforcement authority to state attorneys general are effective. The committee staff argues that these measures do not provide "substantially independent enforcement mechanisms" and would only apply to assets launched after the law takes effect.

Attorney General Letitia James of New York led 18 bipartisan state attorneys general urging Congress to block the bill, arguing it weakens states' ability to combat crypto fraud. The push came just one day before the procedural vote.

Banks also expressed concerns about new "circuit breaker" provisions added to address fears that stablecoin reserves could drain local bank deposits. Financial industry views remain divided on whether these measures adequately address deposit outflow risks.

Crypto industry advocates have criticized recent wording that reduces protections previously included in the Blockchain Regulatory Clarity Act (BRCA), signaling the bill is not solely pro-industry.

Republican Senator Susan Collins from Maine has yet to decide her position on the CLARITY Act, calling it a "moving target" and citing concerns about its 600+ pages and new ethical provisions. She stated she needs to review whether certain clauses could lead to decreased bank deposits in local communities.

With Democratic objections over ethics provisions, state enforcement concerns, banking sector worries about deposit outflows, industry criticism of reduced protections, and undecided Republican support, the CLARITY Act faces a multi-layered opposition at its most precarious stage yet.
