The U.S. Senate's failure to advance the 'Clarity Act' has returned the responsibility of resolving virtual asset regulatory ambiguity to the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC).

According to Bloomberg, the Senate conducted a procedural vote on the Clarity Act but failed to meet the threshold required for advancing its review. The bill aimed to clarify whether virtual assets are securities or commodities and define the regulatory scope of the SEC and CFTC.

Following the bill's failure, virtual asset-related stocks dropped sharply. Coinbase fell 10%, stablecoin issuer Circle declined over 11%, and Bitcoin (BTC) dipped below $75,000 during the session after a 5.3% intraday drop.

Market analysts suggest that with the Clarity Act's failure, the sustainability of the current pro-virtual asset regulatory approach appears lower. While the Trump administration has seen the SEC and CFTC ease virtual asset regulations, such administrative rules are more subject to change compared to laws passed by Congress.

Austin Campbell, a visiting professor at NYU Stern School of Business, stated that 'the ball is now in the regulators' court,' adding that while regulators can set rules, they lack the stability and longevity of legislation.

Major Wall Street financial institutions with expanding virtual asset operations are not expected to immediately alter their strategies. BlackRock Digital Assets head Brian Michnick said this outcome does not affect current plans or strategy, noting BlackRock manages the largest U.S. Bitcoin spot ETF, IBIT.

The main concern lies in yet-to-be-executed new investments. Traditional financial firms' potential acquisitions of virtual asset exchanges, custodians, or asset managers, as well as expansion into new U.S. operations, may face delays due to prolonged regulatory uncertainty.

Brian Dixon, CEO of Off The Chain Capital, explained that companies planning large-scale acquisitions seek clearer regulatory environments, noting SEC and CFTC could provide significant clarity through their own rules but emphasized the time required for rulemaking and exposure to legal disputes or future administrative policy shifts.

Virtual asset markets have lost a potential growth catalyst. Matthew Hogan, Chief Investment Officer at Bitwise, said if the Clarity Act had passed, it could have been a strong catalyst for the virtual asset market in Q4, but he views its failure as more of a speed bump than an insurmountable obstacle.
