Clarity Act Senate Cloture Vote Fails; Possible Paths Forward

Editor Park Sang-hyeok explained possible scenarios following the failure of the Clarity Act (CLARITY Act) Senate cloture vote.

Cloture is a procedural step requiring at least 60 votes to end debate and proceed to a final vote. The Clarity Act cloture vote on September 16 (KST) ended with 49 in favor and 50 against.

Park noted that during the previous Genius Act Senate cloture vote, it initially failed before passing on a second attempt about ten days later. Based on this data, there is potential for the Clarity Act to pass cloture by September.

However, he cautioned that even if the bill passes in the Senate, it may be difficult to complete both chambers' approval by September as House members will begin returning to their districts starting next week. Additionally, unlike the Genius Act, the Clarity Act is a comprehensive bill with many contentious issues.

Park added that experts suggest the bill could pass before January 2027, but this timeline faces uncertainty due to only about 20 days of congressional session time after November midterms. The resolution of ethical provisions will be a key focus moving forward, as Democratic negotiators who previously opposed the bill may reconsider if these issues are resolved.
