Grayscale acknowledged the disappointing outcome but emphasized continued progress through regulatory agencies such as the SEC and CFTC. The company stated that 'the industry is making remarkable progress through the ongoing work of regulators,' highlighting recent actions by these bodies to clarify digital asset regulations.

The SEC and CFTC jointly issued a March interpretation defining how federal securities laws apply to specific digital assets, categorizing them into digital commodities, collectibles, tools, stablecoins, and digital securities. XRP was included in the digital commodity category. The agencies described this as an effort to increase clarity under existing legal frameworks.

The SEC also advanced its proposed 'Cryptocurrency Regulation Framework' in August, including a $5 million exemption for four years and up to $75 million for 12 months for qualifying issuers. It also introduced conditional safe harbors for certain business activities that could be permanently discontinued.

While regulatory interpretations and frameworks are being developed, the Clarity Act's failure shows that agency actions alone cannot replace comprehensive legislation. Grayscale maintains that U.S. crypto regulation will continue to mature through both regulatory measures and potential future legislative efforts.
