Warren Senator Pushes for Crypto Regulation Despite Clarity Act Opposition

Senate Democratic Banking Committee lead Elizabeth Warren, known as a crypto critic, has stated she opposes the Clarity Act itself but intends to push forward with cryptocurrency regulation. According to CoinDesk on November 16 (local time), Warren views the bill as Washington's first meaningful opportunity for crypto regulation but cannot support the current version.

Warren argued that the legislation should include provisions regulating public officials' crypto investments, enhancing national security, consumer protection, and addressing illicit funds. She criticized the ethics clause for being ineffective in preventing conflicts of interest involving President Donald Trump.

Warren noted that the current ethics provision only assigns enforcement authority to appointees by the president, making it effectively non-operational for the president himself. She further argued the clause merely serves as a weak justification for appearing to curb Trump's crypto business interests.

The Senate began procedural votes on November 16 to advance the Clarity Act but failed to reach the required 60 votes with only 49 in favor. Seven moderate Democratic senators who had participated in months of negotiations also voted against it.

Leading Republican Senator Cynthia Lummis, who has driven the bill, criticized Democrats for changing demands during negotiations and accused them of opposing regulations on politicians' personal crypto investments and consumer protections, which she claims will cede U.S. leadership in cryptocurrency to competitors like China.

If the bill's consideration moves to next year, Warren's role could grow significantly. If Democrats regain control of the Senate in November's midterms, Warren may become chair of the Banking Committee. Meanwhile, Lummis has stated she will not run for re-election in 2025 or 2026, suggesting a shift in Republican negotiation channels.

When asked if she would lead crypto legislation as committee chair, Warren affirmed her intent to work with Democrats, Republicans, and industry stakeholders to create effective regulations safeguarding national security, the economy, and curbing corruption. However, she acknowledged that achieving this requires Republicans to stand up to Trump, which she called a 'very high barrier.'
